RIGHT OF WITHDRAWAL

If the Customer is a consumer within the meaning of Article 3 of Legislative Decree 206/2005 (Consumer Code), has the right to withdraw from the contract, without penalty and without having to specify a reason, within 14 days from the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the goods.

Terms for Exercising the Right of Withdrawal in the Case of Recurring Purchases

In the case of purchases made through a recurring delivery plan, the right of withdrawal may be exercised within 14 days from the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the first item.

How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, the Customer must notify PROMEL S.r.l. of their decision to withdraw from the contract by means of an explicit statement sent before the expiration of the withdrawal period.

The communication may be sent to the contact information listed in the “Contacts” section of the website or mailed to the registered office of PROMEL S.r.l.

The 14-day deadline is considered to have been met if the notice is sent before it expires.

Product Return

If the Customer exercises the right of withdrawal, the Customer must return the products without undue delay and, in any event, within 14 days of the date on which the Customer notified PROMEL S.r.l. of the decision to withdraw from the contract.

The deadline is met if the goods are shipped before the 14-day period expires.

Exclusions

Pursuant to Article 59 of the Consumer Code, the right of withdrawal does not apply, among other things, in the following cases:

• the supply of goods that are custom-made or clearly personalized;
• the supply of goods that are likely to spoil or expire quickly;
• the supply of sealed goods that cannot be returned for hygiene or health protection reasons, if they have been opened after delivery;
• the supply of goods that, after delivery, are inseparably mixed with other goods due to their nature.

Refunds and the Effects of Withdrawal

Upon proper exercise of the right of withdrawal, PROMEL S.r.l. will refund all payments received from the Customer, including standard shipping costs (if applicable and in the event of a full return of the order), without undue delay and in any case within 14 days from the date on which it was informed of the Customer’s decision to withdraw from the contract.

PROMEL S.r.l. may withhold the refund until it receives the goods or until the Customer has provided proof that they have been returned, whichever occurs first.

The refund will be issued using the same payment method the Customer used for the initial transaction, unless otherwise agreed upon by the parties. In the case of cash-on-delivery payments, the Customer must provide their IBAN to allow the bank transfer to be processed.

The direct costs of returning the goods are the responsibility of the Customer.

The Customer is liable for any decrease in the value of the goods resulting from handling other than that necessary to determine their nature, characteristics, and functioning.
